TERMS OF SERVICE & USER AGREEMENT

By purchasing, enrolling in, accessing, or participating in any product, program, service, content, coaching, event, or experience offered by Melissa Kathryn Incorporated (“Company,” “we,” “us,” or “our”), you (“Client,” “Participant,” or “you”) agree to be legally bound by the following Terms of Service and User Agreement (“Agreement”).

If you do not agree to these terms, do not purchase, access, or participate.

1. Scope of Agreement
   
   This Agreement applies to all current and future offerings by Melissa Kathryn Incorporated, including but not limited to digital courses, workshops, trainings, masterclasses, memberships, subscriptions, communities, group coaching, masterminds, one-on-one coaching, consulting, mentorship, Voxer-based or message-based support, live or virtual events, challenges, intensives, in-person retreats, destination experiences, digital downloads, videos, audios, PDFs, workbooks, and any content delivered via website, email, app, or third-party platform.
   
   This Agreement applies regardless of delivery method.
   
   
   
2. Eligibility and Age Requirement
   
   You must be 18 years of age or older to purchase, access, or participate in any offering. Melissa Kathryn Incorporated does not provide services to children or minors.
   
   
   
3. No Professional Advice Disclaimer
   
   All content and services provided by Melissa Kathryn Incorporated are for educational and informational purposes only.
   
   Melissa Kathryn Incorporated does not provide medical, mental health, psychological, legal, financial, tax, or other licensed professional advice.
   
   You acknowledge that you are solely responsible for your decisions, actions, and results and agree to consult qualified professionals as needed. Participation is voluntary and at your own risk. No guarantees are made regarding outcomes, income, health, emotional wellbeing, personal growth, or results of any kind.
   
   
   
4. Assumption of Risk
   
   You understand that coaching, personal development work, live events, and in-person experiences may involve emotional, physical, mental, or psychological challenges.
   
   You voluntarily assume all risks, known and unknown, including but not limited to emotional distress, physical activity, travel-related risks, group dynamics, and personal breakthroughs or discomfort.
   
   You expressly release Melissa Kathryn Incorporated from any liability related to participation in virtual or in-person offerings, including retreats, live events, or travel-based experiences.
   
   
   
5. Results Disclaimer
   
   Any testimonials, statements, examples, or case studies shared by the Company are not promises or guarantees of results. Individual outcomes vary based on many factors outside the Company’s control.
   
   
   
6. Payment Terms and No Refund Policy
   
   All sales are final. No refunds are provided under any circumstances.
   
   If you enroll in a payment plan, you are responsible for completing all payments. Failure to complete a payment plan does not void this Agreement. Missed or failed payments may result in revoked access to programs or services.
   
   Chargebacks, disputes, or payment reversals are strictly prohibited and may result in immediate termination of access and additional legal action.
   
   
   
7. Intellectual Property
   
   All content, materials, recordings, and intellectual property provided by Melissa Kathryn Incorporated are owned exclusively by the Company.
   
   You may not copy, reproduce, distribute, resell, sublicense, share, record, or exploit any materials without prior written permission. Sharing login credentials or program access is prohibited.
   
   Violation may result in immediate termination of access and legal enforcement.
   
   
   
8. Confidentiality and Community Conduct
   
   You agree to maintain confidentiality regarding other participants’ identities, shared information, group discussions, and private communications.
   
   Harassment, discrimination, disruption, or inappropriate conduct will result in immediate removal from programs without refund.
   
   
   
9. Termination
   
   Melissa Kathryn Incorporated reserves the right to terminate or suspend access at its sole discretion if this Agreement is violated, payments are not completed, or conduct is harmful, abusive, or disruptive.
   
   Termination does not entitle you to a refund.
   
   
   
10. Limitation of Liability
    
    To the fullest extent permitted by law, Melissa Kathryn Incorporated shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from participation in any offering.
    
    Total liability shall not exceed the amount paid by you for the specific product or service.
    
    
    
11. Indemnification
    
    You agree to indemnify and hold harmless Melissa Kathryn Incorporated from any claims, losses, damages, liabilities, costs, or expenses arising from your participation or violation of this Agreement.
    
    
    
12. Mandatory Arbitration and Class Action Waiver
    
    Any dispute arising out of or relating to this Agreement shall be resolved exclusively through binding arbitration conducted in the State of Florida.
    
    You knowingly and voluntarily waive any right to participate in a class action lawsuit or class arbitration.
    
    
    
13. Third-Party Platforms
    
    Melissa Kathryn Incorporated is not responsible for outages, errors, or interruptions caused by third-party platforms, including payment processors, hosting services, or communication tools.
    
    
    
14. Governing Law
    
    This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States.
    
    
    
15. Acceptance
    
    By checking the box at checkout, completing a purchase, or accessing any materials, you acknowledge that you have read, understood, and agreed to these Terms of Service.
